Enforcement of Jersey Employment Tribunal Awards is clarified

Islanders who have been awarded compensation by the Jersey Employment Tribunal now have the assurance that they can personally pursue recovery of their awards in the courts.

An ambiguous provision in the Employment Law meant that until a recent judgment by the Royal Court, people could find that despite winning their case in the Tribunal, the law was unclear as to how the successful party should seek to enforce the Tribunal?s decision in the event the losing party failed or refused to pay.

The clarification was given by the Bailiff, Michael Birt, in a judgment handed down recently in the case of Luxicabs Limited v Baal. Mr Birt confirmed that, in making an award, the Tribunal creates a debt between the two parties that can then be enforced by the successful party in the appropriate court.

Collas Crill represented Mary Baal in the Royal Court. We believe it is important that the Court has confirmed that a successful party is entitled to pursue enforcement of their award and has made the process clearer for those who embark on the Tribunal process and for their legal representatives.

In 2010 Mrs Baal brought proceedings in the Employment Tribunal for unfair dismissal from Luxicabs for alleged gross misconduct. Her claim was successful and she was awarded compensation which Luxicabs then failed to pay. Mrs Baal sued them on the award in the Petty Debts Court which again gave judgment in her favour. Luxicabs then appealed against the judgment to the Royal Court.

In the Royal Court, Luxicabs argued that the Tribunal?s decision had been erroneous and unreasonable and that they should have been entitled to re-open its findings before the Petty Debts Court. They also argued that because they had not had a fair trial before the Tribunal they were entitled to a full hearing on the merits before the Petty Debts Court. The Bailiff ruled that these arguments were untenable and dismissed the appeal, meaning that the Petty Debts Court judgment stands. The Bailiff said that the court had no ability to revisit or review the Tribunal?s decision.

There was one issue that concerned the Court, which was one of statutory interpretation. One interpretation of the relevant provision of the Employment Law was that proceedings to enforce an award of the Employment Tribunal have to be brought by the Tribunal itself. However, the Court was of the view that this result would be ?absurd? and confirmed that the position is that the party with the benefit of a Tribunal award (in practice usually the employee) is entitled to bring a court action to recover the amount due. As a postscript, the Bailiff urged that provision be made at future tribunal hearings for the proceedings to be recorded to ensure that parties who may have an arguable appeal are able to advance that appeal with the benefit of a record of the proceedings.

The judgment also represents a word of caution to a losing party taking a similar approach to an award made against it by the Tribunal because the Bailiff also ordered Luxicabs to pay the costs of the appeal that had been incurred by Mrs Baal.

The high life

Want to dress up for dinner, and go out for a great meal, but in a relaxed environment? Sirocco?s your answer.  It?s suitably special without being stuffy and comes with sunset views while you enjoy your supper.

Haute-cuisine just a bit too ?haute? for you? You?re not alone, these days, fine dining?s shaking off its fussy image and taking a more laidback approach to good food.  It?s the fine dining revolution – gone are the starchy white tablecloths and the hushed dining rooms, and in their place, relaxed simplicity.

Sirocco is a prime example of how fine dining doesn?t have to be too formal. With its alfresco balcony tables in the evening sun and the infectious buzz of conversation drifting up from Café Zephyr, this is a restaurant with an easy, laidback atmosphere. Add the extra touches that turn a meal out into a fine dining experience; inventive dishes, amuse-bouches and a sommelier who knows his stuff, and you?ve got a recipe for a perfect night out.

If the weather?s warm, the tables out on Sirocco?s balcony terrace are a definite hotspot.  We were ushered to ours by our waiter, who brought us a platter of warm breads that came with butter and sea salt, and our amuse-bouche – a rich soupy shot glass of beetroot, watercress and balsamic velouté that tasted delicious.

Starters soon arrived, and we loved the scallops and slow-braised pork belly with vanilla cider.  With its balanced flavours, it?s a real winner of a dish.  Victor the sommelier matched it with a glass of crisp Chilean chardonnay. The melting ballotine foie gras with golden raisin purée and cashew nut brittle and sour plum jelly was delicious ? an explosion of flavours and set off perfectly by a blackcurranty glass of velvety black Muscat.

For our main course, we had to try the flambé. Steak cooked in front of you and set alight ? it?s pure food theatre and the ultimate way of ensuring that your medium rare really is.  Rui the Maître D? chatted to us as he cooked the steak at a trolley right next to the table, and when the flames had died down, stirring buttery herbs and sizzling garlic into the sauce and tipping in mushrooms and cream to melt down into a rich sauce.  It?s like watching your very own Masterchef, except that you get to eat the result.  And what a result – rich, melt in the mouth and full of flavour, this is definitely an experience to try.

Chef Steve Walker is a whizz at whipping up adventurous flavour combinations and another must-try is his venison with chocolate.  One of those pairings that look startling but taste amazing, Sirocco?s version comes with blackberries that add a deep fruity edge to an already rich and indulgent dish.  It was incredible, try it with a glass of the Chateau Caronne Bordeaux, another of the sommelier?s wine picks.

Sirocco turns even more romantic at night, as the sky turns inky blue, lanterns twinkle on every table and Claudio the restaurant manager arrives with blankets to keep alfresco diners cosy.  We couldn?t resist testing Rui?s flambé skills again on the crêpes suzette, which are prepared next to your table, soused with Grand Marnier and flambé-ed.  It?s delicious, and a great way of honing your crêpe-making skills, with Rui passing on tips on everything from melting sugar to flambéing without losing your eyebrows.

Chocoholics won?t want to miss the tasting of chocolate, it?s chocolate every way you can imagine and topped off with a Royal Yacht sail made out of… chocolate.  Gold-dusted raspberries and pistachio brittle finish off the dish, and Victor teamed it with a rich, sweet Orange Muscat designed to pick up the fruit tones.  Finish off your evening with a coffee and some petits-fours, or even an after-dinner drink ? the back up of a good hotel bar means that Sirocco has a wide choice of some of the best whiskies and cognacs around.

So if you?re looking for somewhere you can fine dine without feeling on edge, or having to talk in whispers, head to Sirocco.  A relaxed modern atmosphere, sunset views and amazing food. What could be better?

The Club Spa: Restful Resolutions for two

Wow is a word which I feel sums this experience up. Never have I had more ?quality time? with my partner than when we went for this utterly amazing Spa Day at The Club Hotel and Spa.

The day got off to a good start with my partner arriving before me. (Usually I arrive before him, then I send a text, then a few panicked answer phone messages, swiftly followed by an angry text full of expletives.) However as I walked through the reception there he was waiting patiently (with a rather smug look because he?d beaten me there). We went into the spa together; I felt like the whole thing was a big act, and we were masquerading as the ideal couple who do this sort of thing all the time. The receptionist suspected nothing as we held hands and smiled fondly at each other (possibly for the first time since we were interviewed by our son?s prep school).

The receptionist handed us over huge soft robes, slippers and towels and led us down to their pool and relaxation area; which has soft lighting, herbal refreshments and luxurious loungers inviting you to rest and recline. And that is exactly what I did! My partner however decided to try everything out. He started with a dip in their salt pool, and a sit on the hydrotherapy bench and then had a go in the herbal steam room, followed by a sauna and experience shower to cool off. At that point the receptionist popped down to lead us up to our lunch.

We had both opted for the chicken and mushroom risotto and it was delicious. It felt so decadent to be sitting in robes in the middle of the day eating delicious food. The sun was shining on their outside pool area and it literally felt like we were on holiday.

After lunch we were led through to a beautifully designed mosaic-tiled shower room and steam room. The therapist told us that she would leave us to put the salt scrub all over one another?s bodies, then shower it off, then we had to go into the steam room and cover ourselves in a mud solution and then sit and relax.  We were like kids in a sweet shop, we were so excited. There was such a lovely feeling of being away from everything. We then showered the smoothing salt concoction off and went into the little steam room chamber and had a lovely time sloshing mud all over each other! We then sat down to let the steam get to work. I found it such a lovely bonding experience, we never get a chance to have real fun and this was just the perfect way to get close and really spoil ourselves. Once the steam stopped we pressed a little button and jets of water washed all the remaining mud off our newly rejuvenated and softened skin.

We made our way back to the Relaxation Room and there was just time for a glass of iced water before our two therapists came to lead us to our double treatment room.  We then had our back massages and facials. I?ve had quite a few facials in my time (every time I look in the mirror without makeup on, in utter despair, I convince myself I deserve a facial) and I can happily report that this was the nicest one I have ever had; there was so much attention to pressure points and scalp massage throughout, and my therapist was just obscenely gifted at neck and shoulder massages ? utter bliss.  On the other hand it was my partner?s first, however he was really happy with it, he said it was really bizarre and nice to have all the different textures of products put on his skin and he loved how clean and revitalized his skin felt afterwards. The two hours spent on the massages and facials flew by, when the therapists left the room to let us get up in our own time, we exchanged matching disbelieving looks at just how nice our day had been.

We finished back in the Relaxation Room, (which is very aptly named!) totally ?blissed out? just lying there figuring out how on earth everything could have gone so well.  I would like to write a thank you letter to whoever invented the Restful Resolutions Package. Five stars. This is literally an unmissable offer.

We caught up with Vicky Panting, a member of the Paul Mitchell Artistic Team to talk about the new Awapuhi Wild Ginger products and Summer hair trends.for 2011

What is Awapuhi?
The awapuhi plant is an ancient beauty essential and was used by Hawaiian natives to nourish and moisturize skin and hair. Awapuhi leaves all hair types soft, silky and hydrated. At Paul Mitchell we use the most lipid-rich part of the plant?s root to seal in moisture and add shine.

What is your favourite product of the Paul Mitchell Range?
It?s difficult to choose just one, but at the moment I?d have to say either Awapuhi Wild Ginger Styling Treatment Oil or Awapuhi Wild Ginger Texturizing Sea Spray. The products contain KeraTriplex which is found only in the Awapuhi Wild Ginger collection it is virtually identical to the keratin found in human hair. Like a liquid form of hair, it repairs damage from the core to the cuticle and transforms strands into pillars of strength.

Which celebrity is getting it right with regards to hair style / colour at the moment?
I?m loving Amanda Seyfried?s gorgeous beachy look with lighter colour on the ends.
